1. Agreeing to these terms

These terms are an agreement between you and Shock Agent Studios ("we", "us"), the makers of Masoosh. They apply when you visit playmasoosh.com or footmassagegame.com, play the game in your browser, or play the desktop version. By using any of them you agree to these terms and to our Privacy Policy. If you don't agree, please don't use them.

If you get Masoosh through a store such as Steam or itch.io, that store's own terms also apply to your purchase or download.

2. Who can play

Masoosh contains mature themes and is intended for adults. You must be at least 18 years old, or the age of majority where you live if that is higher, to use the site or play the game.

3. Playing Masoosh

Masoosh is free to play. We give you a personal, non-exclusive, non-transferable, revocable licence to access and play the game for your own non-commercial entertainment, under these terms. This is a licence, not a sale: we keep all rights we don't expressly give you.

Masoosh is in active development and labelled as a beta. Stages, features, balance and content may change, be added or be removed at any time.

4. Your saves

Your progress is stored in your browser on your own device, not on our servers. Clearing your browser data, using private browsing, or switching browsers or devices can lose it, and we can't recover a lost save. The game offers save codes so you can keep a backup.

5. What you may not do

Please don't:

• hack, attack, overload or disrupt the site, the game or our servers, or try to get into parts of them you aren't meant to reach;
• use bots or scripts to flood our forms, bug reports or waitlist, or send anything unlawful, abusive, threatening, or that infringes someone else's rights;
• copy, re-host, sell or redistribute the game or its files, or present it as your own;
• remove or change copyright or trademark notices;
• use the game or our content in a way that breaks the law.

6. Videos, streams and fan content

We love seeing people play. You are welcome to:

• stream and record Masoosh, and post gameplay videos, clips and screenshots;
• earn money from them through the normal programmes of the platform you post on (such as ads, subscriptions, tips or channel memberships);
• make fan art and fan writing about Masoosh and its characters, and share it for free.

In return, please:

• don't sell merchandise or other physical or digital products that use our characters, art, logos or music without our written permission;
• don't suggest that your content is official or endorsed by us unless we've said so;
• don't use our content in anything hateful, unlawful, or that targets real people;
• credit Masoosh where you can. A link to playmasoosh.com is always appreciated.

We may ask you to take down content that doesn't follow these rules, and we can update this permission at any time.

7. What belongs to us

Masoosh and everything in it (the characters, art, writing, music, sound, code and the Masoosh name and logo) belong to Shock Agent Studios or our licensors, and are protected by copyright, trademark and other laws. Masoosh, the Masoosh logo and all characters, names and related marks are trademarks of Shock Agent Studios.

8. Things you send us

Feedback and bug reports. If you send us ideas, suggestions or reports, we may use them to improve Masoosh freely, without owing you anything for them. Thank you; they genuinely shape the game.

Creator applications. Applying doesn't create any obligation on either side. If we build a stage with you, it will be under a separate written agreement covering your footage, your rights and your share. Only send us footage you own or have the right to share.

9. Donations

Donations are voluntary gifts that support the development of Masoosh. They are processed by Stripe on Stripe's own page, and they don't buy any goods, services, in-game items, currency or advantages. Because a donation is a gift, it is generally not refundable. If you donated by mistake or were charged the wrong amount, email us within 14 days and we will sort it out. Nothing in these terms takes away any refund rights you have under the law where you live.

10. Other websites

Our pages link to other sites, including Instagram, TikTok, X, Stripe and our sister app TUNAS. We don't control them and aren't responsible for their content or practices; their own terms apply.

11. The game "as is"

Masoosh is a free game in development, and we provide it "as is" and "as available". As far as the law allows, we make no promises that it will always be available, uninterrupted or free of bugs, or that it will work on every device or browser. Some stages use your microphone; whether you allow that is up to you.

12. Our liability

As far as the law allows, we are not liable for indirect or consequential losses, or for lost data such as a cleared save. Our total liability to you for anything relating to Masoosh is limited to the greater of the amount you have paid us in the past 12 months (including donations) or USD 50.

Nothing in these terms limits liability that can't be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, and nothing affects your statutory rights as a consumer.

13. Changes and ending access

We may update these terms as Masoosh grows. When we do, we'll change the date at the top, and if a change is significant we'll make it clear on the site. Continuing to play after an update means you accept the new terms.

We may suspend or end access for anyone who seriously or repeatedly breaks these terms. You can stop using Masoosh at any time.

14. Governing law

These terms are governed by the laws of the place where Shock Agent Studios is established. If you live in the EU, the UK or another country that gives you consumer protections, you keep those protections and can bring a claim in the courts where you live. If any part of these terms can't be enforced, the rest still applies.
